Terms of service
Last updated: 1 November 2026.
These Terms of Service ("Terms") are a binding contract between you and Devesh Mukesh Varma, an individual based in India who operates Kapabl ("Kapabl", "we", "us"); Kapabl is not yet incorporated. They govern your use of kapabl.dev, the Kapabl MCP endpoint at kapabl.dev/mcp, and sign-in at auth.kapabl.dev (together, the "Service"). By using the Service you agree to these Terms and to our Privacy policy. Questions go to legal@kapabl.dev.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract, including under Section 11 of the Indian Contract Act, 1872, where it applies. If you use the Service for an organization, you confirm that you can bind that organization. You may not use the Service if you are subject to US or Indian economic sanctions.
2. Pre-alpha service and testnet payments
The Service is an experimental pre-alpha preview. It may change, fail or stop at any time without notice, and data, configurations or logs stored in it may be permanently lost. Payment features run only on test networks ("testnets"), with simulated tokens that have no monetary value.
3. Accounts and AI agent authorization
You sign in with your Google account. You are solely responsible for all activity under your account, including every API call, tool execution and automated action taken by apps, large language models or AI agents you connect to kapabl.dev/mcp. AI systems are non-deterministic: you are responsible for checking, monitoring and revoking the access you give them.
4. Acceptable use
You may not use the Service, or let a connected AI agent use it, to:
- access, scrape or automate any website, API or app that you do not own or are not explicitly authorized to automate;
- get around rate limits, authentication, CAPTCHAs or bot-protection systems;
- break any US, Indian or international law, infringe intellectual property or privacy rights, or send malware, spam or unauthorized payloads;
- threaten the unity, integrity, defence, security or sovereignty of India, or otherwise breach Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
- interfere with, overload or reverse-engineer the hosted Service.
We may suspend or end access immediately for any breach of these rules.
5. Open-source code and the hosted Service
Kapabl's source code is licensed separately: the core under AGPL-3.0, and the SDKs, schemas and CLI under Apache-2.0. Those licences govern your use of the code, including self-hosting. We keep all rights in the hosted Service, the Kapabl name and branding, and our infrastructure. You grant us a limited licence to host, transmit and process the data and requests you route through the Service, solely to provide and secure it.
6. Indemnification
You agree to defend, indemnify and hold harmless Kapabl and its operator from any third-party claims, liabilities, damages and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or actions taken by AI agents or apps connected to your account.
7. No warranty
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. KAPABL DOES NOT WARRANT THAT THE SERVICE OR ANY AI OR MCP EXECUTION WILL BE ACCURATE, SAFE, UNINTERRUPTED OR ERROR-FREE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAPABL IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR BUSINESS OPPORTUNITIES ARISING FROM OR RELATED TO THE SERVICE. KAPABL'S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) 100 US DOLLARS (OR ITS EQUIVALENT IN INDIAN RUPEES).
9. Governing law and disputes
- Users in India: these Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts in Bengaluru, Karnataka have exclusive jurisdiction.
- Users in the United States and the rest of the world: these Terms are governed by the laws of the State of Delaware, USA. Any dispute will be resolved only by final and binding individual arbitration administered by the American Arbitration Association. You and Kapabl each give up any right to a jury trial and to take part in a class action.
10. Changes to these Terms
We may update these Terms. For a material change, we will update the date above and announce the change on this page and on the sign-in page before it takes effect. Continuing to use the Service after a change takes effect means you accept the new Terms.
